Terms of Service

Please read these Terms of Service carefully before using Wintora, operated by Feezza Inc. By accessing or using Wintora, you agree to be bound by these terms. If you do not agree, do not use Wintora.

1. About Wintora

Wintora is a software platform developed and operated by Feezza Inc., a Delaware corporation. Wintora provides hospital revenue cycle teams with tools to analyze denied insurance claims, identify recoverable denials, and generate appeal letter drafts to assist in the claims appeals process.

Wintora is an administrative software tool. It is not a law firm, does not provide legal advice, and does not practice medicine. Appeal letters generated by Wintora are drafts intended to assist healthcare providers and must be reviewed by the submitting provider prior to submission. Nothing in Wintora constitutes legal or medical advice.

2. Who Can Use Wintora

Wintora is intended solely for use by licensed healthcare providers, hospital systems, healthcare organizations, and their authorized revenue cycle staff. By using Wintora, you represent that you are authorized to act on behalf of a healthcare organization and that your use complies with all applicable laws including HIPAA.

You must be at least 18 years of age to use Wintora.

3. HIPAA and Protected Health Information

Wintora processes Protected Health Information (PHI) as defined under HIPAA on behalf of Covered Entities. Before uploading any patient data to Wintora, Customers must execute a valid Business Associate Agreement (BAA) with Feezza Inc.

Customers are solely responsible for ensuring their use of Wintora complies with HIPAA and all applicable federal and state privacy laws. Do not upload any patient data without a signed BAA in place. Contact legal@feezza.com to execute a BAA.

4. Acceptable Use

You agree to use Wintora only for lawful purposes. You agree not to: upload data you are not authorized to process; use Wintora to generate fraudulent or false insurance appeals; attempt to reverse engineer or copy Wintora's software or appeal logic; use Wintora in violation of HIPAA or any applicable law; or share your account credentials with unauthorized parties.

5. Appeal Letters — Important Disclaimer

Appeal letters generated by Wintora are produced using automated software based solely on the information you provide. Every generated letter includes the following disclaimer:

"This appeal letter was generated with the assistance of Wintora software by Feezza Inc. The clinical and administrative assertions contained herein are based on information provided by the submitting provider and have been auto-generated using established claims appeal frameworks. This letter should be reviewed by an authorized representative of the provider prior to submission. Feezza Inc. makes no warranty regarding the outcome of any appeal."

Feezza Inc. does not guarantee that any appeal letter will result in a successful claim outcome. The success of an appeal depends on clinical documentation, payer policies, and other factors outside Feezza's control.

6. Intellectual Property

Wintora, including its software, design, appeal generation logic, and all content, is owned by Feezza Inc. and protected by copyright, trade secret, and other intellectual property laws. These Terms do not grant you any ownership rights in Wintora.

You retain full ownership of all data you upload. Feezza Inc. does not claim any ownership over your data. Upon termination, your data will be deleted or returned per your BAA.

7. Limitation of Liability

To the fullest extent permitted by law, Feezza Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of Wintora, including loss of revenue from denied claims, regulatory penalties from appeals submitted using Wintora-generated letters, or any data breach caused by your failure to maintain appropriate access controls.

Feezza Inc.'s total liability for any claim shall not exceed the amount you paid to Feezza Inc. in the three months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Feezza Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of Wintora, your violation of these Terms, your violation of HIPAA or any applicable law, or any appeals submitted using Wintora-generated letters.

9. Modifications

Feezza Inc. reserves the right to modify, suspend, or discontinue Wintora at any time. We will make reasonable efforts to notify active Customers of significant changes. Continued use after any modification constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
